We believe that clinical ethics consultants (CECs) should offer advice, options, and recommendations to attending physicians and their teams. In their article in this issue of The Journal of Clinical Ethics, however, Kornfeld and Prager give CECs a somewhat different role. The CEC they describe may at times be more aptly understood as a medical interventionist who appropriates the roles of the attending physician and the medical team than as a traditional CEC. In these remarks, we distinguish the role of (...) the CEC from that of the physician, in contrast to some of these authors’ recommendations, which confuse the two roles. (shrink)

I wish to defend a functionalist approach to the mind-body problem. I use the word ‘functionalist’ with some reluctance, however; for although it has become the conventional label for the sort of approach taken by such philosophers as H. Putnam and D. C. Dennett, I believe it is somewhat misleading. The functionalist, as I understand him, tries to show how there can be machine analogues of mental states and then argues that just as we are not inclined to postulate an (...) ontological dualism between simulated mental states and the machine's physical states, we need not postulate a dualism between mind and body. The functionalist also argues, however, that it is wrong to identify the mental states or simulated mental states with the physical states.Recently functionalism has come under attack, first for not being a coherent alternative, and secondly for not being able to provide an adequate account of sensations. I believe that the first objection is misguided and shall deal with it in section I. However, I agree that functionalists have not provided an adequate account of sensations, but I shall try to help remedy this in section II. (shrink)

In recent years, scholars have put forth a formidable defense of Kant's views on moral motivation. Their common goal has been to disclose the emotional dimension of his practical philosophy, an aspect of his thought arguably concealed by a couple of centuries of wrongheaded criticism. Yet a systematic study of the subjective factors that underlie moral performance as Kant understood it was missing. This dissertation tries to fill that gap. I reconstruct his theory of moral performance since 1755, and show (...) why he ends up developing views that have aroused so much criticism. I share many of those criticisms and ask: Why do we have to assume that pure reason has driving mechanisms of its own? In order to answer this question, I focus first on what he calls the aesthetic preconcepts that make the mind susceptible to concepts of pure duty, and conclude that he does not succeed in showing a convincing connection between the moral law and the feeling of respect. Moreover, the theory that he puts forth to overcome this difficulty--the fact of reason--proves to be even more unsatisfactory. Problems beset his view of conscience as well. I show that the conception of the self that supports his definition of conscience is vulnerable to the change of self-deception. I finish with an examination of the religious beliefs that keep moral interest alive, but my conclusion is once more not favorable to Kant. Those beliefs seem to have no power for accomplishing the function that he has reserved for them. It could even be argued that they are intrinsic to the process of self-deception. (shrink)

Oedipus, taking his cue from the (...) oracle, does away with Laius, violently rebuffs the sphinx, then takes their places—as king and “scourge of the city,” respectively. Again, Oedipus, taking his cue from the oracle, plots the death of that unknown figure who may be seeking to usurp his own position. Oedipus, Creon, and Tiresias, each taking his cue from the oracle, seek one another’s downfall.All these acts of violence gradually wear away the differences that exist not only in the same family but throughout the community.—René Girard, Violence and the SacredRené Girard does not include feminine relationships in his assessment of the Oedipus myth, yet the same redundancy that characterizes the males marks the females.1 Jocasta conjoins in one person multiple and redundant social roles: she is the mother and wife of the same person, for which she [End Page 1] hangs herself, leaving for Oedipus “many pains that a mother’s furies fulfilled” (Homer Odyssey 11.279–80). Her daughters, their father’s sisters, manifest kinship redundancy in two persons. Incest produces circularly, reverting to a sibling of the parent rather than moving forward with a descendant. The absence of linear progression from one generation to the next creates a sameness and equilibrium that thwart separation and individuality. Oedipus’s brothers/sons fail in their adult roles, because neither can overcome the other’s right to the throne of Thebes and the mastery of its royal household. They are enemy brothers locked in reciprocal violence.2 Antigone and Ismene have escaped notice not only as enemy sisters but even as products of the same incest. Audiences for Sophocles’s Antigone have viewed them as “normal” women and cooperated with his characters in emphasizing the differences between them. They have assumed from Antigone’s betrothal to Haemon and resistance to Creon that she is the elder, more mature sister.3 They tend to accept without question that Antigone engages in burial rituals with Polyneices’s corpse (241–58) and returns to it (442–35).4 Bernard M. W. Knox’s critically powerful concept of the “Sophoclean hero” has bolstered this view of Antigone while reducing Ismene to a foil, and abetted the tendency of modern producers of the play to cast an older or more famous actress in the role of Antigone.5 Naturalistic readings like that of C. M. Bowra—“seeing that Ismene is her only close relative in the world, Antigone is remarkably cold to her”6—have masked the source and hence the vehemence of Antigone’s fury.That the reciprocity of the violence between Ismene and Antigone has gone unnoticed is understandable in view of the familiarity of the conflict between their brothers. Males in Greek society pursued difference by striving to excel as aristoi (best) in competition for prestige, wealth, and power.7 Whenever Eteocles and Polyneices came together, each asserted a right to Oedipus’s household and throne that was equally matched, and violence ensued from the equilibrium. On the other hand, Greek women were not supposed to compete with one another for distinction. They wove wool for clothes, maintained the household, and cared for the children, the sick, and the dead, activities that required cooperation away from public view.8 Proximity to other women was the norm and desideratum. Moreover, lawgivers like Solon based their funeral legislation on the premise that every woman wanted to participate in mourning.9 For the sake of public tranquillity, legislators tried to limit the numbers of women participants by imposing restrictions according to degrees of kinship, for instance, to children of fifth cousins. The purpose of this study was to examine the impact of parenting and adolescent fearfulness on adolescents’ pro‐social values and pro‐social and antisocial behaviour. A total of 134 adolescents (M age = 16.22, 72 girls, 62 boys) responded to questions regarding their own fearfulness, pro‐social values and pro‐social and antisocial behaviour, as well as their perceptions of maternal attachment and maternal appropriateness. Results revealed few main‐effect findings, most notably a negative relation between attachment and antisocial behaviour. However, findings pointed to (...) several multiplicative relations as a function of parenting, adolescent fearfulness, and child gender, including: (1) maternal appropriateness was more important for boys than for girls, (2) maternal attachment was related to greater importance of pro‐social values and higher pro‐social behaviour for boys low on fear and (3) maternal appropriateness was related to lower antisocial behaviour for boys low on fear. The discussion focuses on the importance of examining the multiplicative relations between parenting and adolescent temperament and the implications of this for both educators and parents. (shrink)

This book presents a comprehensive overview of what the criminal law would look like if organised around the principle that those who deserve punishment should receive punishment commensurate with, but no greater than, that which they deserve. Larry Alexander and Kimberly Kessler Ferzan argue that desert is a function of the actor's culpability, and that culpability is a function of the risks of harm to protected interests that the actor believes he is imposing and his reasons for acting in (...) the face of those risks. The authors deny that resultant harms, as well as unperceived risks, affect the actor's desert. They thus reject punishment for inadvertent negligence as well as for intentions or preparatory acts that are not risky. Alexander and Ferzan discuss the reasons for imposing risks that negate or mitigate culpability, the individuation of crimes, and omissions. (shrink)

Instrumental CSR perspectives suggest that selective investments in prosocial, voluntary behaviors are largely profit-driven, whereas institutional theory emphasizes legitimacy-seeking as a significant mechanism for explicit CSR disclosure. We test both profit-seeking and legitimacy-seeking mechanisms, derived from empirical findings of Western-oriented firms, in a unique setting to understand voluntary CSR disclosure in an Eastern context: South Korea. By examining voluntary disclosure of the 500 largest South Korean firms’ social contributions from 2006 to 2012, a time period purposefully encompassing the global financial (...) crisis, we highlight the limitations of corporate social responsibility theorizing when East meets West. Our findings suggest profitability is not significantly related to voluntary disclosure as predicted by Western, instrumental CSR literature. Overall, we found support for legitimacy-seeking mechanisms as the likelihood of disclosure increased for publicly listed firms and those employing a larger number of workers for all years between 2006 and 2012. Further, firms affiliated with chaebols are more likely to disclose prosocial behaviors prior to, and after, the GFC compared to firms that are not affiliated with chaebols regardless of profitability further suggesting that legitimacy-seeking mechanisms may underlie CSR reporting in Korean firms. Over the past four decades, stakeholder research has united a chorus of voices from different disciplines using different terminology for different audiences all related to a seemingly similar topic: those that affect and are affected by business. By juxtaposing a comprehensive review of the early years of stakeholder research against more recent stakeholder research, we identify areas of common convergence as well as emergent scholarship. We develop an organizing framework consisting of three stakeholder-related themes: who or what is a stakeholder; (...) mechanisms underlying stakeholder relationships; and outcomes-oriented stakeholder research. Future research opportunities include: simultaneously examining multiple stakeholders at multiple levels; multiplier effects along the value chain and across geographies; and net impacts. We conclude by identifying how stakeholder research can “move the needle” on important business issues such as: income inequality and CEO pay; human rights and building community inclusion; disease alleviation; and food security in firms’ continuous quest to create value. The gist of Edward Said’s attack on Israel is that Zionism is racism. The very appearance of his essay in a special issue devoted to racism is an interesting fact in itself. But the fact that the editors up until now received no responses to Said carries special significance. It signals, or can be read as signaling, that the literary-critical establishment has reached a consensus and that liberal supporters of Israel in our discipline have retreated from the field.I may be (...) wrong about this, of course, for other explanations are possible, but Houston A. Baker, Jr.’s observations a year later on that special issue would seem to reinforce my view. Baker describes Said’s method as aiming “to prove that ‘A’ is as good as ‘B’ and to induce shame in defenders of ‘B’ who have made other axiological choices.” Baker protests against this method, however, since it gives too much play to “B,” so that “it is difficult to hear a Palestinian voice separate from the world of Jewish discourse.” Then he adds in parentheses: “”2 In Baker’s language, only Jews are likely to disagree, and these “Jews,” conceived as a unitary group, are a client state and are compared by means of allusion to the corrupt, libidinous king who executed the true prophet , the herald of Jesus. The Test of Basic Auditory Capabilities is a battery of auditory-discrimination tasks and speech-identification tasks that has been normed on several hundred young normal-hearing adults. Previous research with the TBAC suggested that cognitive function may impact the performance of older adults. Here, we examined differences in performance on several TBAC tasks between a group of 34 young adults with a mean age of 22.5 years and a group of 115 older adults with a mean age of 69.2 years recruited from (...) the local community. Performance of the young adults was consistent with prior norms for this age group. Not surprisingly, the two groups differed significantly in hearing loss and working memory with the older adults having more hearing loss and poorer working memory than the young adults. The two age groups also differed significantly in performance on six of the nine measures extracted from the TBAC with the older adults consistently performing worse than the young adults. However, when these age-group comparisons were repeated with working memory and hearing loss as covariates, the groups differed in performance on only one of the nine auditory measures from the TBAC. For eight of the nine TBAC measures, working memory was a significant covariate and hearing loss never emerged as a significant factor. Thus, the age-group deficits observed initially on the TBAC most often appeared to be mediated by age-related differences in working memory rather than deficits in auditory processing. The results of these analyses of age-group differences were supported further by linear-regression analyses with each of the 9 TBAC scores serving as the dependent measure and age, hearing loss, and working memory as the predictors. Regression analyses were conducted for the full set of 149 adults and for just the 115 older adults. Working memory again emerged as the predominant factor impacting TBAC performance. It is concluded that working memory should be considered when comparing the performance of young and older adults on auditory tasks, including the TBAC. (shrink)

Facing an increasing number and variety of issues with social salience, firms must determine how to engage with issues that likely have a significant impact on them. Integrating issues management and salience theories, the authors find that firms engage with socially contested issues—where there is a high degree of societal disagreement—in a different manner from issues that have social consensus, or high agreement. Examining social issue resolutions filed by shareholders from 1997 to 2009, the study finds that socially contested issues, (...) as well as those issues with social consensus, are both likely to result in engagement by the firm. For social issues with consensus, a firm is more likely to opt for a low level of shareholder engagement whereas resolutions regarding contested issues lead to engaging shareholders at a higher level. These findings shed new light on the IM and issue salience literature streams that have suggested firms will react differently to these types of issues, even while they remain largely untested. Finally, firms become less engaged with perennial issues over time. rather than more, providing new guidance to researchers, shareholder activists, and firms alike. To the authors’ knowledge, such fined-grained insight into expected levels of firm engagement with social issue salience has not been put forth previously. (shrink)

This article extends earlier research concerning the relationship between corporate social performance and corporate financial performance, with particular emphasis on methodological inconsistencies. Research in this area is extended in three critical areas. First, it focuses on a particular industry, the chemical industry. Second, it uses multiple sources of data-two that are perceptual based (KLD Index and Fortune reputation survey), and two that are performance based (TRI database and corporate philanthropy) in order to triangulate toward assessing corporate social performance. Third, it (...) uses the five most commonly applied accounting measures in the corporate social performance and corporate financial performance (CSP/CFP) literature to assess corporate financial performance. The results indicate that the a priori use of measures may actually predetermine the CSP/CFP relationship outcome. Surprisingly, Fortune and KLD indices very closely track one another, whereas TRI and corporate philanthropy differentiate between high and low social performers and do not correlate to the firm's financial performance. A plethora of normative conservation concepts have recently emerged, most of which are ill-defined: biological diversity, biological integrity, ecological restoration, ecological services, ecological rehabilitation, ecological sustainability, sustainable development, ecosystem health, ecosystem management, adaptive management, and keystone species are salient among them. These normative concepts can be organized and interpreted by reference to two new schools of conservation philosophy, compositionalism and functionalism. The former comprehends nature primarily by means of evolutionary ecology and considers Homo sapiens separate from nature. The latter comprehends (...) nature primarily by means of ecosystem ecology and considers Homo sapiens a part of nature. Biological diversity, biological integrity, and ecological restoration belong primarily in the compositionalist glossary; the rest belong primarily in the functionalist glossary. The former set are more appropriate norms for reserves, the latter for areas that are humanly inhabited and exploited. In contrast to the older schools of conservation philosophy, preservationism and resourcism, compositionalism and functionalism are complementary, not competitive and mutually exclusive. As the historically divergent ecological sciences—evolutionary ecology and ecosystem ecology—are increasingly synthesized, a more unified philosophy of conservation can be envisioned. (shrink)

Background: Many people participating in dementia research may lack capacity to give informed consent and the relationship between cognitive function and capacity remains unclear. Recent changes in the law reinforce the need for robust and reproducible methods of assessing capacity when recruiting people for research.Aims: To identify numbers of capacitous participants in a pragmatic randomised trial of dementia treatment; to assess characteristics associated with capacity; to describe a legally acceptable consent process for research.Methods: As part of a pragmatic randomised controlled (...) trial of Ginkgo biloba for mild-moderate dementia, we used a consenting algorithm that met the requirements of existing case law and the exigencies of the new Mental Capacity Act. We decided who had capacity to give informed consent for participation in the trial using this algorithm and sought predictors of capacity.Results: Most participants with mild-moderate dementia in this trial were unable to give informed consent according to the legal criteria. When adjusted for confounding, the Mini Mental State examination did not predict the presence of capacity.Conclusion: Cognitive testing alone is insufficient to assess the presence of capacity. Researchers and clinicians need to be aware of the challenging processes regarding capacity assessment. We outline a procedure which we believe meets the ethical and legal requirements. (shrink)
